"COON – Cheese on Toast – Toastie 2" promotion.
- Information on how to enter and prizes forms part of these conditions of entry. Submission of an entry is deemed acceptance of these conditions of entry.
- Entry is only open to Australian residents. Employees (and their immediate families) of the Promoter, participating retailers and agencies associated with this promotion are ineligible to enter.
- Promotion commences 04/08/08. Entries close and must be received by 11:59pm AEDST on 31/10/08 (“Promotional Period”). The major prize draw will take place at Level 22, 385 Bourke Street, Melbourne, VIC, 3000 on 03/11/08 at 12:00pm AEDST. Winners will be notified in writing (instant winners will be notified immediately) and the major prize winner’s name will be published in The Australian on 20/11/08. The Promoter’s decision is final and no correspondence will be entered into.
- To enter, entrants must, during the Promotional Period:
- (purchase 1 x specially marked participating Coon product (“Eligible Purchase”) from any participating store;
- visit www.naturallycoon.com.au and enter the required personal details along with the last 6 digits of the Eligible Purchase’s product barcode;
- build the entrant’s cheese toastie using the interactive component of the website; and
- submit.
- Entrants must retain a photocopy of their purchase receipt(s) for all entries as proof of purchase. Failure to produce the proof of purchase for all entries when requested may, in the absolute discretion of the Promoter, result in the invalidation of all of an entrant’s entries and forfeiture of any right to a prize.
- The Promoter reserves the right to verify the validity of entries and entrants (including an entrant’s identity, age and address) and to disqualify any entrant who submits an entry that is not in accordance with these conditions of entry or who tampers with the entry process (including but not limited to tampering by way of use of automated entry software). Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
- Multiple entries are permitted, however:
- only one entry is permitted per Eligible Purchase;
- each entry must be submitted separately and in accordance with the entry requirements;
- unrecognised barcode numbers will render the corresponding entry invalid; and
- a maximum of one entry permitted per person per day.
- Incomplete or indecipherable entries will be deemed invalid. Any incorrect details submitted may render the corresponding entry invalid.
Instant win prizes
- Instant win prizes: 20 x $100, 120 x $50, 600 x $20 & 269 x Toastabags valued at $9.95 each. Total instant win prize pool value is $22,676.55. Upon submitting their entry, entrants will be notified immediately via an on screen pop up if they are an instant winner. Instant winners’ and non-winners’ entries will be eligible to be entered into the major prize draw (as set out in clause 10). Instant win prizes will be awarded in the form of a cheque made out to the particular winner. Quality control errors will not invalidate an otherwise valid prize claim. Unless otherwise due to fraud or ineligibility under these conditions of entry, all prize claims in excess of the advertised prize pool will be honoured.
Major Prize - Cooking Demonstration and participation in the Game for the chance to win either $1million, $30,000 or $10,000"
- Entries will be divided into groups according to each selection and component of the toastie made by the entrant when building their toastie (for example, entrants who choose a particular type of bread, who chose to butter their bread on both sides, selected a single slice of Tasty cheese, to be cooked under a grill, until ‘crispy and golden’ would form one group, while entrants who chose the same bread but with no butter, and who selected a single slice of Tasty cheese, to be cooked under a grill, until ‘crispy and golden’, would form another etc..). The group that, as determined by the Promoter in its sole discretion, has the highest number of entries will be the group that is entered into the draw. If more than one group is determined by the Promoter in its sole discretion to have the equal highest number of entries, the Promoter will in its sole discretion select only one of the tied groups to be entered into the draw. From the group(s) of entries selected for the draw, the first valid entry drawn will win the major prize. The major prize consists of the opportunity for the winner to participate in the Cooking Demonstration and the opportunity to participate in a game for the chance to win either $1,000,000.00, $30,000.00 or $10,000.00 (“Game”). Accordingly, in addition to the Cooking Demonstration, the major prize will be either $1,000,000.00, $30,000.00 or $10,000.00, but only one of those amounts will be won. The Cooking Demonstration requires the winner to prepare and cook their winning toastie on television at a time and place to be determined by the Promoter. Ingredients will be supplied by the Promoter. The Game may also be recorded and broadcast on television. Entrants should note that, if the Promoter is unable to secure a television appearance, the Cooking Demonstration component of the prize may be cancelled and no compensation will be provided in lieu. It is intended that the Cooking Demonstration and Game will take place on 17/11/08 (but this date is subject to change at the Promoter’s sole discretion). The Game will take place at Quad 1, 8 Parkview Drive, Sydney Olympic Park, NSW 2127 (but this location is subject to change at the Promoter’s sole discretion).
- The Cooking Demonstration and Game will take place on a date, time and place to be advised by the Promoter. To participate in the Cooking Demonstration and the Game, if the winner resides more than 200km from the capital city in which the Cooking Demonstration and Game are to take place, he/she will receive two return economy airfares from his/her nearest capital city or regional commercial airport (as decided by the Promoter in its sole discretion) in Australia to the capital city in which the Cooking Demonstration and Game are to take place and one night’s twin share accommodation for 2 people valued at up to a total combined value of $4,000.00, depending on point of departure (any unused portion of this component of the prize is forfeited). If the winner resides within 200km of the capital city in which the Cooking Demonstration and Game are to take place, neither flights nor accommodation will be awarded (and cash will not be awarded in lieu) and the winner will be responsible for making his/her way to the Cooking Demonstration and the Game. In any event, spending money, meals, taxes, insurance and transport to and from departure point to the Cooking Demonstration and Game venue, items of a personal nature (including but not limited to additional room charges such as pay per view movies, laundry, room service, telephone calls), any upgrades or additional nights and all other ancillary costs are not included and are the responsibility of the winner. If the winner cannot attend the Cooking Demonstration or the Game, the winner may appoint a proxy over 18 years of age to attend the Cooking Demonstration (and play the Game) on the winner’s behalf provided that the winner gives the Promoter written and signed notice to that effect before the start of the Cooking Demonstration, and prior to any flight or accommodation bookings being made (if relevant). If the Promoter has not been able to contact the winner before the commencement of the Cooking Demonstration, a representative of the Promoter will participate in the Cooking Demonstration and Game on the winner’s behalf.
The Game
- After the Cooking Demonstration, the winner (or the winner’s proxy) will participate in the Game. There will be 25 money bags on display at the commencement of the Game. Of the 25 money bags, 3 will contain a message representing $1,000,000.00, 5 will contain a message representing $30,000.00 and 17 will contain a message representing $10,000.00. The winner (or the winner’s proxy) must select money bags, one at a time, until the winner (or the winner’s proxy) has 3 matching monetary amounts. Once the winner (or the winner’s proxy) has 3 matching monetary amounts, no further money bags may be selected and, subject to verification by the Promoter, the winner will be awarded the amount shown in the 3 selected matching money bags as their prize (totalling either $1,000,000.00, $30,000.00 or $10,000.00). When the winner (or the winner’s proxy) selects a money bag, they must do so without touching, handling or interfering in any way with any of the other money bags on display. If the winner (or the winner’s proxy) is found to have breached this condition, he/she will be disqualified from continuing to participate and the winner will automatically win the $10,000.00 prize.
- The odds of winning the $1,000,000.00 prize, once selected as the winner, are 1: 126.
- If the winner of a major prize is under the age of 18 years, the prize will be awarded to the winner's nominated parent or guardian.
- If for any reason whatsoever beyond the reasonable control of the Promoter, the promotion is not capable of being conducted as reasonably anticipated, the Promoter reserves the right, in its sole discretion, unless to do so would be prohibited by law, to (a) disqualify any entrant; and/or (b) subject to any written directions from a regulatory authority, to cancel, suspend, modify, terminate or cancel the promotion.
- Total prize pool value is up to $1,026,676.55. Prizes are not transferable, exchangeable or redeemable for cash unless otherwise specified.
- If required, an unclaimed prize draw may take place on 4/02/09 at the same time and place as the original draws, subject to any directions from a regulatory authority. Winners’ names (for any prizes valued at over $100) will be published in The Australian newspaper on 18/02/09.
- Any costs associated with accessing the promotional website are the entrant’s responsibility and is dependent on the Internet service provider used. The use of any automated entry software or any other mechanical or electronic means that allows an entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that entrant invalid.
- Each entry submitted as part of an entry becomes the property of the Promoter. As a condition of entry, each entrant irrevocably grants to the Promoter a non-exclusive perpetual worldwide licence to use and exploit all intellectual property rights (including without limitation, copyright) in and to the entry and consents to the Promoter doing (or omitting to do) any acts in respect of the entry which may otherwise constitute an infringement of the entrant’s moral rights. For the avoidance of doubt, the Promoter may use all or any part of an entrant’s entry for any purposes at its discretion, including, without limitation, using the entrant’s entry for promotional, marketing or publicity purposes, whether in respect of this promotion, the Promoter, or otherwise.
- Except for any implied condition or warranty the exclusion of which from these conditions of entry would contravene any statute or cause any part of these conditions of entry to be void (“Non Excludable Condition”), the Promoter excludes from these conditions of entry all conditions, warranties and terms implied by statute, general law or custom. Except for liability in relation to a Non Excludable Condition, the Promoter (including its officers, employees and agents) excludes all liability whether arising in tort (including without limitation negligence), contract or otherwise for any personal injury or any other loss or damage (including without limitation loss of opportunity or loss of profits) whether direct, indirect, special or consequential, arising in any way out of the promotion, including, without limitation, the following:
- any technical difficulties or equipment malfunction (whether or not under the Promoter’s control);
- any theft, unauthorised access or third party interference;
- any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter;
- any variation in prize value to that stated in these conditions of entry;
- any tax implications;
- the cancellation (or postponement) of the Cooking Demonstration; and/or
- a prize.
- Each entrant consents, if the entrant becomes a prize winner, to the Promoter and their designees using the entrant's name, likeness, image and/or voice (incl. photograph, film and/or recording of the same) in any media for an unlimited period of time without remuneration for the purpose of promoting this competition (including any outcome), the Promoter and/or any products or services supplied by the Promoter.
- The Promoter collects personal information in order to conduct the Promotion and may, for this purpose, disclose such information to third parties, including, but not limited to, prize suppliers and for any purpose required under Australian lottery legislation or any other regulatory authority. Entry is conditional on providing this information. If an entrant “opts in” at the time of entry, the Promoter may also use the information for promotional, marketing and publicity purposes. Entrants should direct any request to access, update or correct information to the Promoter. All entries become the property of the Promoter.
